If You do not legally abide by these terms and conditions, including the disclaimer and the privacy policy, You may not access or use this website.

 

At our sole discretion, we reserve the right to amend, add, or delete any part of these terms and conditions at any time, and all changes shall be valid and effective as soon as they are published. Therefore, please review these terms and conditions periodically to see the changes that occur thereon. 2.             GENERAL CONDITIONS

 Tutor Trip is a site designated for users seeking Tutoring services ("Students") and for users seeking to provide Tutoring services ("Tutors"), and for any third party that accepts these terms on their behalf. The expression "You" or "You" or "User" or "Users" shall refer to Students, Tutors, or any person or entity who views, uses, accesses, browses, or submits any content or material to Tutor Trip. The terms and conditions apply immediately upon approval, and it governs the relationship between You and Tutor Trip, including the provision of any of the Services on Tutor Trip. For Tutor Trip's usage purposes, the terms and conditions will prevail in the event of any conflict between these terms and conditions with any other Tutor Trip documents, policies, or contents, no express waiver or failure to promptly exercise any right under these terms will result in a permanent waiver or any expectation that this right will not be implemented.  If You do not agree to legally abide by these terms, and all the terms and conditions included or referred to in this document, or any additional terms and conditions provided on this website, including the disclaimer and the privacy policy, You may not use Tutor Trip in any way and You must leave immediately. If any condition is held invalid under any law, any regulation issued by any government, or by any court or arbitrator, the parties agree to replace this condition with a new condition that meets the original commercial purpose, while keeping the other conditions in full force and effect.

 

3.             SERVICES

 You are responsible for Your own actions and mistakes. Tutor Trip is only a market for connecting Students and Tutors, in case of any dispute with another user, You must disclaim the responsibility of Tutor Trip (and our parents, affiliates, administrators, shareholders, employees, agents, partners, consultants, successors and assigns) from all claims, costs, damages (actual and consequential) and any material or moral damages of any kind, known and unknown, suspected and unforeseeable, disclosed and undisclosed, arising from, or in any way linked to, these disputes. As independent contractors hired by Students, Tutors control the methods, materials, and all aspects of the lessons. We only support the Tutor's decisions and the choices You make. These are Your decisions and Your choices. We cannot make decisions on Your behalf.

 

We only help You communicate with Tutors. At Tutor Trip, You can ask Tutors questions for appropriate educative answers. Students are responsible for choosing the right Tutor for their needs. Hence, when deciding to hire a Tutor, students should review and verify the Tutor's self-certification documents, academic education, professional experience, as well as feedback from other students. All Tutoring sessions must be supervised by a reasonable adult.

 

The information contained in Tutor Trip, about Tutors, review sheets, universities, etc., is included by collecting data from various open educational sites. The details provided are for general information only. We regularly update the data to ensure that the information You receive from our website is accurate.

Tutor Trip controls and manages its website from different locations and makes no commitment that this site is suitable for, or available in all places. Tutor Trip services may not be available in Your place, and the available services may vary depending on the location. In addition, Tutor Trip will attempt to deliver all correspondence sent via Tutor Trip's messaging system. Tutor Trip does not, however, guarantee delivery of all messages.

 

 

Tutor Trip reserves the right to withdraw or modify some or all of Tutor Trip services, as long as we have legal or commercial reasons to do so. There may also be times when the Tutor Trip service becomes inaccessible as a result of technical difficulties experienced by Tutor Trip or on the Internet; we will, however, use reasonable skill and care to overcome these difficulties where they are within our control.

 

4.    PROHIBITED ACTIVITIES

 You acknowledge and agree that the services provided by Tutor Trip are intended to facilitate the educational process, not for any illegal purposes. You agree not to use Tutor Trip to hire Tutors for illegal purposes such as to complete assignments, to write test/exam papers, take quizzes, or otherwise do work on Your behalf. Furthermore, You agree not to use Tutor Trip's services for any purpose that violates the scientific and academic honesty policy or other conduct policies of Your school, college, university, academic institution, or workplace.

 

You agree not to use Tutor Trip for: (a) violating, or inciting to violate, any local, domestic national, or international law (b) stalking, harassing, or harming another person (c) collecting or storing personal data about other Tutor Trip users (d) impersonating any person or body, or misrepresenting Your relationship or affiliation with any person or body(e) interfering with, or disrupting Tutor Trip or services or networks related thereto, or violating any requirements, procedures, policies, or instructions of any of the networks connected to Tutor Trip. You agree not to use Tutor Trip to send any message that is illegal, defamatory, abusive, sexually explicit or implicit, threatening, obscene, profane, racially offensive, or objectionable, as specified by Tutor Trip, at its own and sole discretion.

 

Without our written consent, You may not: (1) reproduce, duplicate, copy, sell, resell, exploit any part of Tutor Trip, use Tutor Trip or access Tutor Trip for any commercial purpose (2) allow to, enable or support the publication or transmission of unwanted commercial and advertising material via e-mail (spam) (3) use devices of high energy and capacity or automated and electronic software (including but not limited to robotic software, spider software, scripts, or other automated software) to access Tutor Trip, monitor or copy our web pages or the content therein (4) use a deep link to Tutor Trip no matter what the purpose is or (d) restrict Tutor Trip, place pop-ups on its pages, or any other way that affects the display the pages thereof.

 

5.     ELIGIBILITY AND CONDUCT

If You are a minor, (i.e., under the age of 18). You are not entitled to register as a user of the site or to deal with it.  In this case, You can use Tutor Trip or take advantage of its services with,  and under the supervision of the parents or the guardian who has already agreed to the terms and conditions. If You are a father,  a mother, or a legal guardian of a minor child under the age of 18, You may use Tutor Trip or its services on behalf of that minor child.

 

By using Tutor Trip or Services on behalf of a minor child, You represent and warrant that You are the parent or the legal guardian of such minor child. If You do not qualify under these terms, do not use Tutor Trip or Services. Membership in the Services is void where prohibited by applicable law, and the right to access Tutor Trip is revoked in such jurisdictions. By using Tutor Trip and/or services, You acknowledge and warrant that You have the right, eligibility, and ability to enter into these terms and comply with all the conditions set out herein.

 

You agree on: (a) providing accurate, up-to-date, and complete information in accordance with the registration application form on the website ("REGISTRATION DATA”) ;(b) maintaining the confidentiality of Your password and identity (c) updating the registration data and any information You provide to Tutor Trip to keep it accurate, up-to-date and complete and (e) accepting all risks of unauthorized access to registration information and data. You can send Your feedback about Your experience with Your Tutor to Tutor Trip, send Your queries about potential educational needs, contents submitted by Tutors or any other educational material, and participate in other interactive and community features in Tutor Trip (collectively referred to as (" SUBMITTED CONTENT "). It is important that You act responsibly when providing Submitted Content.  When submitting feedback, please provide clear and honest information about the Tutor, and Your experience therewith, away from using inappropriate language, making unprovoked criticisms or personal comments, or providing information that others can use to identify You. When participating in other interactive or community aspects of the Service, please do not post any information that another user or Tutor may use to identify You as an individual, but please do include all relevant information in a concise manner to help us provide You with a helpful response.

 

You acknowledge and agree that by submitting the Submitted Content to us, You (1) grant us a non-exclusive, permanent, transferable, irrevocable, and fully licensable right to use, reproduce, modify, adapt, translate, distribute, publish and create derivative works from and publicly display and perform the Submitted Content throughout the world in any media, now known or hereafter created without attribution  (2)) grant us the right to prosecute any person or entity that violates or infringes Your rights and/or our rights in Your Submitted Content (3) forever waive all Your rights, including but not limited to, material and moral rights, if any, in Your Submitted Content, including, but not limited to, any rights or identification signals indicate to You, or identify You as the author of the Submitted Content or any content taken therefrom. You also acknowledge and agree that Your Submitted Content is confidential and does not contain any proprietary information referring to You. 

 

Except as described in our Privacy Policy, we will not be required to treat the Submitted Content to us by You as confidential, and You acknowledge and agree that we may use, in accordance with our work, any of the concepts and ideas contained in Your Submitted Content without compensating You, and we will not be liable to You as a result of any similarities between the concepts and ideas contained in the Submitted Content and between our future operations and actions. Except as stipulated in these terms and conditions, we are fully entitled to use the Submitted Content for any commercial purpose or any other purpose without compensating You or any other person.

 

Submitted Content, including the personally identifiable information contained therein, is generated voluntarily and without coercion and is subject to the Privacy Policy. You are responsible for the Submitted Content and agree to, defend and compensate us, and discharge our liability from any damages, losses, costs, or expenses, including reasonable attorney's fees that we may incur as a result of the Submitted Content.

 

In Submitted Content, You acknowledge, warrant, and agree to:

a) If the Submitted Content is relevant to the Tutor, this content must be correct and accurate, and it is meant or related only to the educative care or service that You, Your minor child or guardian, received, by the Tutor being reviewed, that You are not associated with and is not employed by the Tutor being reviewed, and that You do not impersonate anyone else.

b) If You are a Tutor submitting or editing any Submitted Content, the Content You submit must be correct and accurate, and You are the Tutor specifically concerned with the content that is submitted or edited, and Your content submission process will only be relevant to Your content and the services You provide.

c) If You are a person authorized by the Tutor to send or edit the Submitted Content associated with this Tutor, this content must be correct and accurate, and that You are authorized by the Tutor, who is concerned with the Submitted or modified Content to make these modifications, and that the Submitted Content will be linked to that Tutor, and that the services were provided by that Tutor.

d)You have the right to create the Submitted Contents providing not violating any copyright, commercial or trademark, patents, or other intellectual property rights of any person or entity, and the Submitted Contents must not contain any personal data or personally identifiable information (other than the name of the Tutor whose lessons being reviewed) or any information or material of any kind relating to or refer to any person or entity other than the person or entity under review.

 

 

 

 

 

 

 

 

 

 

The Submitted Content shall not violate any law, or in any way infringe or interfere with the rights of others, including but not limited to the use of names, information, or material which are (1) libel, defame, or invade the privacy of any third party (2) obscene or pornographic material (3) harmful material or information, threatening, offensive, abusive, harassing, vulgar, false or inaccurate, or racist, racially, sexually, ethnically or are otherwise objectionable or otherwise contrary to the laws of any place where such Submissions may be accessed (4) constitute personal attacks on other individuals (5) infringe the intellectual property, trade secrets or proprietary  rights of any third party (6) promote criminal activity or any illegal activity (7) promote or advertise any person, product, service, or solicit funds or (8) are considered confidential under any contract or policy.

 

We reserve the right to publish Your Submitted Content as a part of the Service as well as to remove Your submitted content for any reason. However, we are not responsible for any failure or delay in removing the Submitted Content. We do not provide content provided by Tutor Trip.  Users of Tutor Trip provide Content on Tutor Trip. The Tutor determines which questions to answer; they are not employees or agents of Tutor Trip but they are independent service providers using Tutor Trip to provide their expert knowledge to users of Tutor Trip.

We do not participate in any conversations between users, nor do we refer You, or endorse or recommend a particular Tutor. You recognize and acknowledge that we cannot edit, modify, filter, examine, monitor, approve, or guarantee all content in Tutor Trip.  We shall not be liable for any acts or omissions of Tutor or, Content, the ability of Tutor to answer questions, or the ability of Students to pay for tuitions. We do not ensure that users will complete a transaction.

 

By using Tutor Trip, You acknowledge and warrant that You currently meet, and will continue to meet the following eligibility conditions ("ELIGIBILITY CONDITIONS") as long as You use Tutor Trip: (a) You have and will at all times comply with all laws and regulations; (b) You have the right, authority and capacity to enter into these Terms and Conditions and to abide by all of terms and conditions; (c) neither You, nor anyone in Your home: (i) has been the subject of a complaint, restraining order or any other legal action involving violence, abuse, neglect, fraud, larceny, or any offense that involves endangering the safety of others; (ii) has been convicted of a crime of any nature, including any felony or misdemeanor of any kind, including without limitation any sexual, child abuse or domestic violence offenses; and/or (iii) has been and/or is currently required to register as a sex offender in any jurisdiction or with any government entity; and (d) neither You, nor anyone in Your home, is currently out on bail or on Your own recognizance pending trial, relating to any felony or misdemeanor charges of any kind, including without limitation sexual, child abuse or domestic violence offenses.

 

By using Tutor Trip, You understand and agree that Tutor Trip may rely on the above Eligibility Conditions representations and warranties as true. You understand and agree that Tutor Trip may revise the Eligibility Conditions any time and require new conditions and certifications and that the User will abide by such revised Eligibility Conditions or discontinue using Tutor Trip.

 

You hereby authorize Tutor Trip to verify the above representations and warranties by You and You acknowledge and agree that Tutor Trip shall have the right, but not the obligation, to verify such representations and warranties. You agree and understand that such verification may include, without limitation, conducting criminal background checks, sex offender registry checks, motor vehicle records checks, identification verifications, and/or use of available public records. You consent to any collection, use, or disclosure to accomplish such verification. You further agree that Tutor Trip may take such action as it, in its sole discretion, deems appropriate, including without limitation suspending and/or terminating Your use of Tutor Trip, should it determine that You have violated any representation or warranty.

Notwithstanding the preceding paragraph, You understand and agree Tutor Trip does not conduct background checks of any User. You also understand and agree Tutor Trip neither confirms nor denies the validity of the information provided by Users and that Tutor Trip does not verify that any or all of the Eligibility Conditions are met by Users. You understand and agree to make Your own decisions and assessments about persons to engage and that it is Your sole responsibility to conduct any and all background and reference checks regarding other users.

 

Tutor Trip expressly disclaims, and You expressly release Tutor Trip from, any liability whatsoever for any controversies, claims, suits, injuries, and/or damages arising from and/or in any way related to: (a) any inaccuracy, untimeliness, or incompleteness regarding a User's Eligibility Conditions and/or (b) misstatements or misrepresentations made by any User. Tutor Trip reserves all of its rights to remove anything objectionable to Tutor Trip at its sole discretion. Alleged improprieties by any User may be reported to Tutor Trip by email at support@TutorTrip.com

 

6.    FEES AND REFUNDS

Tutor Trip may, at its discretion, review, or change fees without any prior notice. Refunds are subject to Tutor Trip estimate.

 

7.    THIRD-PARTY REPORTS

Tutor Trip may appoint any third party that performs and/or carries out, among other things, criminal background checks, sex offender registry checks, and identity verification ("THIRD-PARTY REPORTS"). Tutor Trip does not acknowledge or provide any statements or guarantees regarding the credibility of checks, accuracy, readiness, or completeness of any relevant information. Tutor Trip does not independently verify the information contained in their reports. You agree, under this document, that Tutor Trip collects, uses, and discloses the information contained in third-party reports, or an investigation of a complaint against a user, but Tutor Trip will not be committed or responsible in any way for any inaccurate, incomplete, or misleading information, if the information contained in third-party reports about this user, to name but a few, is inaccurate, or incomplete. Any user, who is subject to third-party reports, can contact the service provider to challenge the accuracy of this information, or to object to its untimeliness or incompleteness. Tutor Trip reserves the right to comment and/or terminate the relationship with the user based on the information contained in the consumer reports, or for any other reason at Tutor Trip's sole discretion.

 

 

8.    CONFIDENTIALITY OF TUTOR TRIP INFORMATION

 

Through Tutor Trip, You can directly access certain confidential information about Tutor Trip and its affiliates, including but not limited to technical, contractual, productive, pricing, marketing, and other information that should be logically interpreted as confidential information ("CONFIDENTIAL INFORMATION"). Therefore, You must treat this confidential information very discreetly. All property rights, title, and interests in that confidential information must remain in the hands of Tutor Trip and its affiliates. Despite the previous clause, the terms do not impose any obligation on You, as You can legally prove with a sufficient evidence: (a) that You obtained it before receiving Tutor Trip, without the obligation to maintain its confidentiality (b) or it has become known to the public without any act or negligence on Your part, or without violating the terms of (c) obtained by a third party with the right to Disclosure, without an obligation to maintain the confidentiality of this information (d) in response to an effective order issued by a court or other government body, as required by law, or as necessary to establish the rights of either party under these terms, and as disclosed after prior notice to Tutor Trip sufficient time to allow Tutor Trip an opportunity to object to disclosure.

9.    ADVERTISEMENTS AND PROMOTIONS

 Tutor Trip has the right to run third-party ads and promotions on Tutor Trip. Your correspondence or business dealings with advertisers  -including payment and delivery of relevant goods or services and any terms, conditions, warranties, or other disclosures associated with these transactions- or participation in advertiser promotions, are non-advertisers contracted with Tutor Trip or located through Tutor Trip, between You and that advertiser only. Tutor Trip should not be considered committed or responsible for any loss or damage of any kind that occurs as a result of any of these transactions or as a result of the presence of non-Tutor Trip advertisers on Tutor Trip.

 

10. THIRD PARTY LINKS

Placement of information, logos, links, or the names of the Tutors or any other third party on Tutor Trip does not mean that they are authenticated, that they are guaranteed the services they provide, support their opinions, or support their products. Therefore, You must take full responsibility for the decision to visit or care for any such entity, and to disclaim Tutor Trip's liability for any dependency arising from such actions. Also through this agreement with Tutor Trip or through Your participation in Tutor Trip, You must not claim a relationship (as a partner, agent, shareholder, or employee)between You and Tutor Trip or any other user including Tutors, education centers, or any other third parties.

 

We do not control the information provided by the Tutor, educational centers, bodies, users, affiliates, and other third parties, which You may find offensive, harmful, inaccurate, or deceptive. You are responsible for assessing the accuracy, completeness, and usefulness of any opinion, answer, or other content available through Tutor Trip from a third party, or obtained from a link on the site. Therefore, please seek advice from specialized, as needed, for the assessment of any opinion, answer, product, service, or other content.

 

11. TEXT MESSAGE & PUSH NOTIFICATIONS

 We may send a variety of text messages including WhatsApp messages, PUSH notifications to new students, reminders, job opportunities and many more (the "TEXT MESSAGING PROGRAM"). Please note that standard data and messages may be priced for any text message notifications. Please contact Your mobile operator for details. A price may apply to Your mobile operator's standard data and messages on any messages sent to You or sent to us. If You have any questions about Your text message plan or data, please contact Your mobile operator.

 

 

12. INTELLECTUAL PROPERTY RIGHTS

Tutor Trip permits You (which may be revoked at any time for any reason or no reason) to use the services on Tutor Trip as provided in this document and following the terms and conditions of use and for personal and non-commercial use purposes (except as stipulated), provided that You do not remove any commercial trademarks, copyrights, or other notice on these pages. No other use is permitted. You may not, for example, include information, content, or other material under any database, classification, archive, or cache. Except as specifically stated by TutorTrip, You may not use a deep electronic link to Tutor Trip at any end, or access Tutor Trip manually or by any robotic software, spider software,web crawler, data extraction software, any other automated process to scrape, copy, or monitor any part of Tutor Trip or to extract, monitor or copy information, content and materials on Tutor Trip. Tutor Trip reserves all its rights in national law and common law against any person or entity that violates this clause. Any rights that are not granted or referred to here are clearly reserved for Tutor Trip. Except as expressly authorized by Tutor Trip or by content providers, You agree not to reproduce, modify, lease, lend, loan, sell, distribute, copy, frame, republish, download, transfer, or create works derived from other people's content, in whole or in part, by any means. You must not modify, decompile, or reverse engineer of any software that reveals to You the Tutor Trip website, and You may not remove, or modify any copyright, trademark, or other notice relating to ownership. "Tutor Trip Trademarks" means all names, trademarks, brands, logos, designs, trade dress, slogans and other designation used by Tutor Trip and associated with its products and services. You may not remove or change any of Tutor Trip's trademarks, or create a trademark of Your products or materials shared with Tutor Trip trademarks without Tutor Trip's prior written consent. You agree not to include or merge any of Tutor Trip trademarks with (in) Your trademarks service marks, company names, internet addresses, website domain, or any other similar designation, for use in, or in connection with products, services, and technologies related to computer and internet. Unless expressly stated in this document, none of these terms may be interpreted as agreeing to grant any license to intellectual property rights, whether by legal estoppel, embedding, or otherwise. Permission notice (for example, "used with permission") to this content (b) this content is for personal and non-commercial use; (c) this content shall not be copied or posted on any computer connected or not connected to the internet or posted by any means, except as expressly permitted by authorized or valid license, which includes approval and (d) no modifications to that content are made. This permission ends automatically without notice if You violate any of the terms or conditions contained in this document. Upon termination, You must immediately destroy any downloaded and/or printed Content.

 

13. TERMINATION AND SUSPENSION

Tutor Trip reserves the right to suspend (deactivate) and/or terminate (delete) any user with prior notice or without notice at any time at Tutor Trip's discretion, for any reason or without reason.You agree that, if You are suspended and/or terminated, You will make no further use of Tutor Trip after termination (deletion of profile) or during suspension (deactivation of profile).

14. DISCLAIMER ON GUARANTEES

Using YourTutor Trip site is a personal responsibility unless expressly stated otherwise. Tutor Trip, including information, services, and content, is offered on the basis of "as it is", "as available" and "with all errors". Tutor Trip is not responsible for all express or implied terms, declarations, and guarantees of any kind, including any guarantee or implied requirement for marketing ability, acceptable quality, or suitability for a particular purpose. Tutor Trip does not provide any guarantees or undertakings that: (a) Tutor Trip will be uninterrupted, accurate, secure, or error-free; (b) the results that can be obtained from the use of the site will be accurate or reliable (c) the quality of any products, services, content, information or other material purchased or obtained from Tutors that meets Your expectations or needs or (d) the errors in Tutor Trip will be corrected. You alone bear all risks relating to any damage to Your computer system, or the loss of data resulting from obtaining any content from Tutor Trip, including any damage caused by computer viruses.

 

15. LIMITATION OF  LIABILITY

You understand and agree that Tutor Trip has no control over the acts or omissions of any user and that Tutor Trip makes no representations or warranties about the quality of the services provided by any user. You understand and agree that Tutor Trip is not responsible for the performance or conduct, whether online or offline, of any user of Tutor Trip. As such, Tutor Trip expressly disclaims any and all liability whatsoever for any controversies, claims, suits, injuries and/or damages arising from and/or in any way related to Tutor Trip. Users of Tutor Trip transact between themselves. Tutor Trip will not be involved in any user interactions. Tutor Trip is not responsible for disputes, claims, loss, injury, or damage of any kind that might arise during and after user interaction. You understand and agree that Tutor Trip has no control over the acts or omissions of any user on or off Tutor Trip and that Tutor Trip makes no representations or warranties about the quality of the services provided by any user. You understand and agree that Tutor Trip is not responsible for the performance or conduct, whether on or off Tutor Trip, of any user. As such, Tutor Trip expressly disclaims, and each user expressly releases Tutor Trip from, any and all liability whatsoever for any controversies, claims, suits, injuries and/or damages arising from and/or in any way related to Tutor Trip, including without limitation any acts and/or omissions of users on or off Tutor Trip.

To the full extent permitted by law, Tutor Trip is not liable for any direct, indirect, punitive, special, incidental, consequential, or exemplary damages (including without limitation loss of business, revenue, profits, goodwill, use, data, electronically transmitted orders, or other economic advantage) arising out of or in connection with Tutor Trip, even if Tutor Trip has previously been advised of, or reasonably could have foreseen, the possibility of such damages, however they arise, whether in breach of contract or in tort (including negligence), including without limitation damages due to: (a) the use of or the inability to use Tutor Trip; (b) the cost or procurement of substitute goods and services resulting from any goods, data, information, or services purchased or obtained, or messages received or transactions entered into, through or from Tutor Trip; (c) statements or conduct of any third party on Tutor Trip, including without limitation unauthorized access to or alteration of transmission or data, malicious or criminal behavior, or false or fraudulent transactions; or (d) content or information users may download, use, modify, or distribute. These limitations shall apply notwithstanding any failure of essential purpose of any limited remedy. Because some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitations may not apply to You. In no event shall Tutor Trip's total liability to You for all damages, losses and causes of action, whether in contract, tort (including but not limited to, negligence) or otherwise, exceed (a) the amount paid by You to Tutor Trip or a Tutor Trip partner, if any, or (b) aud 5000 (whichever is less).

 

You and Tutor Trip agree that the warranty disclaimers and limitations of liability in these terms of use are material, bargained-for bases of this agreement, and that they have been taken into account in determining the consideration to be given by each party under this agreement and in the decision by each party to enter into this agreement. You and Tutor Trip agree that the warranty disclaimers and limitations of liability in these terms of use are fair and reasonable. If You are dissatisfied with Tutor Trip or do not agree to any provisions of these terms of use, Your sole and exclusive remedy is to discontinue using Tutor Trip, except as may be provided for in this section 16.

 

 16. RISK ASSUMPTION

 You understand and agree that You are the only one who carries all the risks when using Tutor Trip, including but not limited to all risks associated with any interactions, whether online or offline.

 

17. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Tutor Trip and its subsidiaries, affiliates, shareholders, officers, directors, agents, licensors, suppliers, other partners, employees, and representatives from and against any and all claims, demands, causes of action, losses, expenses, damages and/or liabilities, including reasonable lawyer's fees and court costs, incurred by Tutor Trip in any way related to Your (a) acts and/or omissions on or off Tutor Trip; (b) violation of any rights of another, including without limitation any alleged infringement of intellectual property or other right of any person or entity relating to Tutor Trip; (c) breach of these terms of use; (d) disputes with or between other Users; (e) use and/or misuse of Tutor Trip, including without limitation any information, content and/or materials thereon; (f) violation of any applicable law or regulation; (g) inaccurate, untimely, incomplete or misleading User information, including without limitation with respect to registration, profile or eligibility; (h) misstatements and/or misrepresentations; (i) use of links to third party websites, including without limitation such websites' availability, terms of use, privacy policy, information, content, materials, advertising, products and/or services; (j) User information and any acts or omissions with respect to such User information; (k) use of any information in third-party reports; (l) use of third party payment processing services; (m) use of phone support services; and/or (n) use of any services or products or any contracts or arrangements made or provided based on information, content and/or materials obtained on or through Tutor Trip. You further agree that You will cooperate as requested by Tutor Trip in the defense of such claims. Tutor Trip reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by Users, and You shall not, in any event, settle any claim or matter on behalf of Tutor Trip without the written consent of Tutor Trip.

 

18. INJUNCTION

You agree that any material or moral breach of the terms will result in irreparable damage to Tutor Trip where the damage sits as improper compensation, and therefore, in addition to its rights and remedies available in law, Tutor Trip is entitled to fair compensation, including an initial and permanent injunction, in the event of such a breach. You waive any requirement to post a bond or other guarantee if Tutor Trip requests such an order.

 

19. NOTICES, MODIFICATION AND TERMINATION OF SERVICES

Tutor Trip may send notifications to users via email or mail or post notes or links to notifications on Tutor Trip. Tutor Trip reserves the right at any time to modify, suspend, deactivate or terminate the Services (or any part thereof), and/or to use or access them, with or without notice. Tutor Trip may also delete, block, or use all relevant information and files. Tutor Trip will not be accountable to users or any third party for any modification, suspension, termination of the Service or loss of relevant information. Tutor Trip may modify these terms at any time by posting the amended terms on this site.

 

20. ENTIRE AGREEMENT

 

These terms and conditions constitute the full agreement between You and Tutor Trip in relation to its subject matter, and cancel and replace any previous versions of the terms. You may not waive or otherly transfer the terms or rights granted under this Agreement. You may also be subject to additional terms and conditions that may apply when using Tutor Trip or third-party products or services.

 

21. FOR TUTORS

1.    The Tutor must ensure that he or she is at least eighteen years old and has the qualifications and/or educational experience legally required to provide lessons in subjects/subjects specified by the Tutor in Trip Tutor.

2.    The Tutor agrees and understands that he is not an employee of Tutor Trip and accepts full responsibility for the taxes it entails, such as income tax and other amounts payable for any fees resulting from the education contract with the student or his guardian through Tutor Trip.

3.    The Tutor understands and agrees that the details entered by him in Tutor Trip will be visible to the public and may appear in the results of search engines (Google, Yahoo, Bing, etc.) and social media platforms (Facebook, Instagram, Twitter, etc.).

4.    The Tutor is fully responsible for all information published by him/about him in Tutor Trip and must compensate Tutor Trip for any liability or losses that Tutor Trip may incur as a result of this information.

5.    The Tutor undertakes to register for Tutor Trip, and always provides accurate and up-to-date information about him -including name, address, telephone number, qualifications, teaching experience and any other details requested by Tutor Trip.

6.    The Tutor should not include personal email, contact numbers, etc. in form fields such as teaching experience, teaching style, and other subjects. The addition of contact details in other designated fields is totally unacceptable. If the Tutor violates this requirement, Tutor Trip, according to its estimate, suspends or terminates the Tutor's account.

7.    Tutors are obliged to show proof or disclose the details of their qualifications to the reasonable satisfaction of the student or his guardian before entering into an educational participation and also if they request it later.

8.    Tutor Trip accepts full responsibility for hourly rates or rates they offer for their services provided in fine detail in the Tutor's profile on Tutor Trip.

9.    The Tutor must compensate Tutor Trip for all claims, costs and damages (actual and consequential) of any kind and whatever their nature, known and unknown, suspicious and unforeseen, disclosed and undisclosed, arising from or in any way associated with such disputes. Tutors control teaching methods, materials and all aspects of lessons as independent contractors selected and appointed by students.

10. The Tutor acknowledges under this document that Tutor Trip is not liable to the Tutor for any fees specified as a result of any breaches of these terms and conditions and/or in the event that any contract or tuition is cancelled for any reason.

11. When responding to student comments posted on Tutor Trip, the Tutor may not, by any means, show disrespect towards the student or his or her family.

12. Tutor Trip is not involved in any kind of interactions between Tutors and students, so Tutor Trip is not responsible for any dispute, disagreement, misinterpretations or disputes arising between parents/students and Tutors. However, parents/students and Tutors are free to receive our feedback to resolve the problem amicably.

13.  The Tutor will be solely responsible, absolutely in charge, towards the student in all matters relating to the obligations/declarations of the Tutor to the student other than those mentioned in Tutor Trip, and the Tutor undertakes to keep Tutor Trip away from any damages against all such claims/disputes.

14.  It is expected that the Tutor will behave in the same way that the Tutor/trainer should behave in a generally accepted and respectable manner in the Tutor-student relationship.

15.  All student information and contact details provided at Tutor Trip must be for personal use only and should not be used for any other purposes.  The Tutor may not sell or forward any student data to other Tutors. If any Tutor involved in such activities, Tutor Trip reserves the right to terminate his/her membership with immediate effect without refunding any payments made by the Tutor.

 

22. FOR STUDENTS AND PARENTS

1.    The student or guardian undertakes to register with Tutor Trip, always entering accurate and up-to-date information about himself - including name, email, mobile phone number, etc.

2.    While booking a Tutor, students must enter as much detail as possible to get better responses from Tutors.

3.    Students or parents should understand that Tutors are not our employees and we cannot take responsibility for verifying their backgrounds and behaviors.

4.    Tutor Trip is just an online site where Tutors can advertise their services that relate to the content they study.

5.    No Tutor can guarantee that the student has a good degree, so the degree You receive cannot be a reason for the student's return later and to claim a refund of the services.

6.     Student/parents should use caution, good judgment and appropriate language when leaving feedback about the Tutor. What You publish will be a permanent part of that Tutor's record. Please specify Your feedback only with teaching skills (communication skills, knowledge, patience, clarity, etc.).

7.    Tutor Trip is not involved in any kind of interactions between Tutors and students, so Tutor Trip is not responsible for any dispute, disagreement, misinterpretations or disputes arising between parents/students and Tutors. However, parents/students and Tutors are free to receive our feedback to resolve the problem amicably.

8.    It is expected that the student will act as a student, which is generally expected and is considered the ideal student behavior prevailing in the education stream.

9.    The cancellation of the entire session will be handled between the Tutor and the student. Tutor Trip is not responsible for any damage caused by such cancellation. Cancellations can be made through the Tutor Trip website. Trip will not be responsible for providing any compensation or damage of any kind to the student if Tutor Trip deactivates the Tutor's account or if the Tutor stops/chooses not to extend the Tutor's sessions.

10. Students should pay sufficient attention and make an intuitive decision before taking on a task to avoid any kind of repercussions. Tutor Trip will not be responsible for any unfortunate and unexpected event including but not limited to physical injury or sexual or mental harassment of any kind, if any.

In case of any discrepancy and/or any dispute arising out of and/ or relating to Tutor Trip’s Terms and Conditions,Privacy Policy, Refund Policy and/or the Cancellation Policy, the Arabic version of such Terms and Conditions,Privacy Policy, Refund Policy and/or the Cancellation Policy shall prevail on/upon the versions published and/or stated therein in other languages
